Mediation
Mediation is a type of an ADR (alternative dispute resolution). The process of mediation is confidential and conducted without any prejudice to impending or continuing litigation between parties. It may take place at any time and the process itself is non-binding until a final written agreement has been signed by the parties – they may walk away from it at any time before the settlement is concluded.
A neutral third party – the mediator is appointed to facilitate the settlement. He is not a judge and cannot rule on the merits neither impose any terms. That is one of the key advantages of the mediation process – the parties reach consensus and “own” their own settlement, not forced by any court.
The benefits of mediation – especially by comparison to litigation:
- it is inexpensive,
- it is short (usually two to three sessions),
- it encourages a dialog between parties rather than escalating conflict,
- it is more flexible than litigation – it offers a wide variety of options,
- it is discreet and confidential.
Mediator
Michał R. Wysocki specializes in civil, commercial and medical malpractice mediation. He is a civil lawyer – currently a deputy notary. Mediation services are performed both in Polish and English language. The mediator has a very good command of English (both business and legal), so the assistance of a translator is not necessary.
